Understanding Hemp-Derived CBD: What the 2018 Farm Bill Actually Means

The 2018 Agriculture Improvement Act — commonly known as the Farm Bill — fundamentally changed the legal landscape for hemp and CBD products in the United States. But the conversation around "federal legalization" often glosses over the nuances that matter most for consumers.

What the Farm Bill Actually Did

The Farm Bill removed hemp from the Controlled Substances Act's definition of marijuana. Hemp is now legally defined as cannabis with less than 0.3% THC by dry weight. This means hemp-derived CBD products that meet this threshold are federally legal — they can be grown, processed, and sold across state lines.

What it did NOT do: legalize all CBD in all forms everywhere. States retain the right to regulate hemp products differently, and the FDA still hasn't issued comprehensive regulations for CBD in food and supplements.

The 0.3% THC Threshold

This is the number that matters. Any hemp-derived product must contain less than 0.3% Delta-9 THC by dry weight to be federally legal. This is why third-party lab testing matters: it's the only way to verify a product actually meets this threshold.

How to Read a COA

A Certificate of Analysis (COA) is a lab report from an independent, accredited laboratory that verifies a product's cannabinoid profile. When reviewing a COA:

  • Check the date — it should be within 12 months
  • Verify the lab is ISO/IEC 17025 accredited
  • Confirm Delta-9 THC is below 0.3% on a dry weight basis
  • Review the full cannabinoid panel for transparency
  • Look for pesticide, heavy metal, and microbial testing
